1. INTRODUCTION
These Standard Service Terms (“Terms”) govern the provision and use of the Optisolar AI service (“Service”) by Solektra d.o.o. (“Company”), designed to optimize solar power production and storage using historical data and AI algorithms. By accessing or using the Service, the user (“User”) agrees to be bound by these Terms.
2. SERVICE DESCRIPTION
Optisolar AI is a data-driven solution that utilizes artificial intelligence to analyze historical energy production and consumption data to enhance efficiency of future production, storage and even consumption of energy. The Service provides predictive insights, recommendations, and real-time monitoring to optimize solar energy usage.
3. DATA COLLECTION AND ANONYMITY
3.1. The Service collects energy-related data, including but not limited to solar power generation, storage levels, consumption patterns, and meteorological inputs.
3.2. All collected data will be processed and stored anonymously, ensuring that no personally identifiable information (PII) is used or shared.
3.3. The Company ensures compliance with applicable data protection laws, including the General Data Protection Regulation (GDPR).
4. USER OBLIGATIONS
4.1. The User agrees to provide accurate data and maintain secure access credentials.
4.2. The User shall not misuse the Service, including attempting to reverse-engineer AI models, modify data outputs, or interfere with the Service’s operation.
4.3. The User is responsible for ensuring compliance with all local laws regarding energy production and storage.
5. SERVICE AVAILABILITY AND SUPPORT
5.1. The Company endeavors to maintain continuous availability of the Service but does not guarantee uninterrupted operation.
5.2. The Company may perform maintenance or updates, potentially leading to temporary downtime, which will be communicated in advance where possible.
5.3. Support is available via email and customer service portals as specified on the Company’s website.
6. INTELLECTUAL PROPERTY
6.1. All AI models, algorithms, software, and other intellectual property related to Optisolar AI remain the exclusive property of the Company.
6.2. The User is granted a non-exclusive, non-transferable right to use the Service solely for optimizing solar power management.
6.3. Unauthorized reproduction, distribution, or modification of the Service is strictly prohibited.
7. LIABILITY AND WARRANTY
7.1. The Company provides the Service “as is” without any express or implied warranties.
7.2. The Company is not responsible for any loss, damage, or inefficiencies resulting from the use of the Service.
7.3. The User acknowledges that AI-driven predictions and recommendations are probabilistic and should not be solely relied upon for critical energy decisions.
8. TERMINATION
8.1. The User may terminate their use of the Service at any time.
8.2. The Company reserves the right to terminate or suspend access if the User violates these Terms.
8.3. Upon termination, all stored data will continue to be anonymized and used for aggregated analytical purposes.
9. GOVERNING LAW AND DISPUTE RESOLUTION
9.1. These Terms shall be governed by the laws of the jurisdiction in which the Company operates.
9.2. Any disputes shall first be resolved through good-faith negotiations. If unresolved, disputes will be settled in the competent courts of the Company’s jurisdiction.
10. CHANGES TO TERMS
10.1. The Company reserves the right to modify these Terms at any time.
10.2. Continued use of the Service after modifications constitutes acceptance of the updated Terms.
